CalenPlan Terms of Use

These Terms of Use (“Terms”) govern your use of the CalenPlan iPhone and iPad application and related native services operated by New Heights Innovations LLC (“CalenPlan,” “we,” “us,” or “our”). By creating an account or using CalenPlan, you agree to these Terms and Apple’s Standard Licensed Application End User License Agreement where applicable. These Terms supplement, and do not replace or contradict, Apple’s agreement or mandatory App Store requirements.

Eligibility and accounts

You must be at least 13 and legally able to agree to these Terms. If you are under the age of legal majority, you must have permission from a parent or legal guardian. The native account-creation flow requires you to confirm this eligibility before creating an account.

You are responsible for accurate account information, protecting your sign-in credentials, and activity under your account. Do not share passwords, verification codes, or access tokens with CalenPlan support.

The first native release uses clean-start accounts. An existing CalenPlan web-app account is separate and does not automatically authenticate, link, or transfer information to the native app. A user-directed transfer file may be imported only after the user chooses it and reviews the proposed content.

License and acceptable use

Subject to these Terms and Apple’s rules, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to use CalenPlan. You may not misuse the service, interfere with security or availability, attempt unauthorized access, scrape or reverse engineer protected services except where law permits, introduce harmful code, infringe another person’s rights, or use CalenPlan for unlawful activity.

Friends & Encouragement is for private connections you choose. You may not use invitations, achievement sharing, or reactions to harass, threaten, impersonate, spam, evade another user’s block, or disclose content you do not have permission to share. CalenPlan may restrict abusive invitation or reaction activity and may remove access when needed to protect users or the service.

Your content

You retain ownership of the goals, tasks, calendars, events, journal entries, images, and other content you provide. You grant us a limited license to process that content only as needed to operate, secure, synchronize, support, export, and improve the requested service. You are responsible for having permission to use or modify calendars and content you connect.

When you deliberately share an achievement, you direct CalenPlan to provide the selected accepted connections with the limited achievement information shown to you. Goal or milestone names are excluded unless you explicitly include them. Predefined encouragement is not professional advice and does not change goal progress. You can mute, remove, or block a connection, but another person may retain information they already viewed or independently recorded.

Planning, calendar, and CalenView limitations

CalenPlan is a planning tool, not medical, legal, financial, employment, safety, or professional advice. Suggestions, open-time results, reminders, imports, and progress summaries may be incomplete or inaccurate. Review important dates, recurrence, time zones, conflicts, and provider changes yourself.

CalenView suggestions may misread an image. Nothing is saved until you review and confirm it. Apple Calendar and Google Calendar control their own availability, permissions, retention, and behavior. You can disconnect an integration without deleting unrelated provider content, but provider-side changes, revoked access, offline changes, and concurrent edits may require reconciliation.

Subscriptions, trial, and billing

CalenPlan offers monthly and annual auto-renewable subscriptions in one subscription group. The App Store displays the applicable localized price, billing period, and introductory-offer eligibility before purchase. Eligible new subscribers may receive a 14-day introductory trial. When a trial ends, the selected subscription renews automatically at the displayed price unless canceled at least 24 hours before the end of the current period, subject to Apple’s current terms.

Payment is charged to your Apple Account. Apple manages billing, cancellation, refunds, renewal, and subscription settings. You can use Restore Purchases in CalenPlan and manage the subscription through Apple’s subscription-management screen. Deleting your CalenPlan account does not cancel an App Store subscription.

Pending, failed, refunded, revoked, expired, grace-period, or billing-retry transactions may change feature access after verification. We do not guarantee introductory-offer eligibility; Apple determines eligibility and presents the authoritative offer.

Availability and changes

We work to provide a reliable service but do not promise uninterrupted or error-free operation. Features may depend on Apple services, including App Store, EventKit, StoreKit, and APNs; Google Calendar; Supabase; Resend; internet access; device permissions; or other systems outside our control. We may maintain, change, suspend, or discontinue functionality when reasonably necessary, while honoring applicable consumer rights.

Termination and account deletion

You may stop using CalenPlan at any time and may delete your native account through the in-app account controls. We may restrict or terminate access for material misuse, legal requirements, security risk, or violation of these Terms, with notice where appropriate. Terms that by their nature should survive termination continue to apply.

Disclaimers and limitation of liability

To the fullest extent permitted by law, CalenPlan is provided “as is” and “as available” without warranties not expressly required by law. New Heights Innovations LLC is not responsible for indirect, incidental, special, consequential, or punitive damages, lost opportunities, or loss caused by missed reminders, inaccurate imports, unavailable providers, or user scheduling decisions.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms limits non-waivable consumer rights.

Governing law and disputes

These Terms are governed by the laws of Kansas, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to non-waivable consumer rights and jurisdictional requirements, disputes must be brought in the state courts located in Douglas County, Kansas, or the United States District Court for the District of Kansas. These Terms do not add an arbitration, jury-waiver, or class-action-waiver provision.

Changes to these Terms

We may update these Terms. We will update the effective date and provide notice when required. Continued use after an effective update constitutes acceptance only to the extent permitted by law.
